X-Nav Technologies, LLC, (“X-Nav” or “Company”) complies with the EU-U.S. Data Privacy Framework (“EU-U.S. DPF”), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (“Swiss-U.S. DPF”) as set forth by the U.S. Department of Commerce. X-Nav has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (“EU-U.S. DPF Principles”) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF. X-Nav has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (“Swiss-U.S. DPF Principles”) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles (collectively, the “DPF Principles”), the DPF Principles shall govern. SCOPE 

This Data Privacy Framework Policy (the “Policy”) sets forth the privacy principles that X-Nav follows when processing Personal Data received from customers or potential customers located in the European Economic Area (“EEA”), Switzerland, and the United Kingdom while providing services from the United States (“USA”). For purposes of this Policy, Personal Data means data about an identified or identifiable individual that is received by X-Nav located in the USA from the EEA, Switzerland, or the United Kingdom, and recorded in any form, and is within the scope of Regulation (EU) 2016/679 (“General Data Protection Regulation” or “GDPR”), the Swiss Federal Data Protection Act, or the UK Data Protection Act 2018, respectively.

Roles in Data Processing 

X-Nav is the legal manufacturer of hardware and software products and is located in the United States. Therefore, USA-based employees may process Personal Data of customers.

In connection with these products, X-Nav provides customer service, product enhancements, data backup services, and product technical support (collectively “Services”) for the benefit of its customers and prospective customers in the EEA, Switzerland, and the United Kingdom. To perform Services, X-Nav processes the Personal Data that customers have chosen to share with X-Nav. X-Nav has no direct or contractual relationship with the subject of such Personal Data (a “Data Subject”). As a result, when a customer or prospective customer shares Personal Data, the customer or prospective customer is solely responsible for satisfying all legal obligations owed directly to the Data Subject under applicable data protection laws.

X-Nav also collects information of customers and prospective customers in the EEA, Switzerland, and the United Kingdom for the purpose of:

  • Providing and improving our products and services,
  • Communicating, including responding to inquiries, providing customer support, notifying of actions such as field service corrective actions, and notifying of product updates,
  • Emailing special offers on products and services,
  • Processing orders and payments, and completing transactions,
  • Personalizing your experience and delivering tailored content,
  • Analyzing usage trends and improving the functionality of our product and website, and
  • Complying with legal obligations and protecting our rights.

Customers using X-Nav’s devices are responsible for managing the data that they store within X-Nav’s devices.

X-Nav Technologies, LLC may share your data with our partner companies (i.e., local distributors and importers) so that they may offer you X-Nav products and provide local services for X-Nav products.

When X-Nav Technologies, LLC processes your order, it may send your data to, and also use the resulting information from, credit reference agencies to prevent fraudulent purchases.

  • At a secure server hosted by AWS in Virginia, USA which is protected by SOC 1 Type 2, SOC 2 Type 2, SOC 3, HIPAA Type 1, and PCI-DSS.

X-Nav Technologies, LLC will keep your data for as long as you are an X-Nav Technologies customer. Once you are no longer a customer, we will delete your data by removing you from our databases unless required to retain by law.

Security 

X-Nav is committed to safeguarding Personal Data we receive. While X-Nav cannot guarantee the security of Personal Data, X-Nav takes reasonable and appropriate measures to protect Personal Data from loss, misuse, unauthorized access, disclosure, alteration and destruction.

X-Nav utilizes a combination of online and offline security, procedures, technology, and organizational measures to safeguard Personal Data. For example, physical security is used to prevent unauthorized access to X-Nav systems. Digital security is in place, including but not limited to network access controls, passwords, access logging, firewalls, role-based restrictions and encryption technology. X-Nav limits access to Personal Data to agents that have a specific business reason for accessing the data. Individuals granted access to Personal Data are aware of their responsibilities to protect such information and are provided appropriate training and instruction.

Marketing and Surveys 

X-Nav Technologies, LLC would like to send you information and surveys about products and services of ours that we think you might like. X-Nav may also send you information about product updates, warranty or product status, new features, and information about your system.

If you have agreed to receive marketing, you may always opt out at a later date.

In some cases, when X-Nav receives Personal Data, it does so on its customer’s or prospective customer’s behalf. To request access to, or correction, amendment or deletion of, Personal Data, Data Subjects should contact the X-Nav customer or prospective customer that collected their Personal Data. X-Nav will cooperate with its customers’ and prospective customers’ reasonable requests to assist Data Subjects to exercise their rights under the DPF.

Onward Transfer 

X-Nav may disclose Personal Data to subcontractors and third-party agents who assist X-Nav in providing Services to its customers and prospective customers. Before disclosing Personal Data to a subcontractor or third-party agent, X-Nav will obtain assurances from the recipient that it will: (a) use the Personal Data only to assist X-Nav in providing the Services; (b) provide at least the same level of protection for Personal Data as required by the DPF Principles; and (c) notify X-Nav if the recipient is no longer able to provide the required protections. Upon notice, X-Nav will act promptly to stop and remediate unauthorized processing of Personal Data by a recipient. X-Nav will remain liable for onward transfers to its subcontractors and third-party agents.

X-Nav may also be required to disclose, and may disclose, Personal Data in response to lawful requests by public authorities, including for the purpose of meeting national security or law enforcement requirements. To the extent permitted, X-Nav will inform its relevant customer or prospective customer before making such disclosure and provide it with a reasonable opportunity to object to such disclosure.

X-Nav will not otherwise disclose Personal Data to third parties.
